Abuse of Process in International Arbitration – practitioner`s view

This paper examines some aspects of the abuse of process in international arbitration. As this topic is too broad to be covered by one article or even a book the topic that shall be presented in this article focuses on the possible answer of the counsels when faced with the possible abuse of process in international arbitration by other party and/or its counsel. This paper shall provide the author’s view on use of remedies available in such situations, but also his opinion that the remedies are not always the best option for the prudent counsel. Lastly, this article is based more on the practical experience of the author, gained in the process of representation of different parties in the arbitration, than on the scholarly research of this topic. Therefore it contains the analysis of different factual scenarios, which each practitioner could relate to.
